Our terms and conditions apply to all online conditions of sale from our web site. The terms are set out below. Please read them before ordering. You may wish to print a copy for future reference. Other terms and conditions on our site such as our privacy policy should also be read as part of this agreement. We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.

IN THESE TERMS

Goods means the blinds, diy-self fit roof lantern blinds manufactured or supplied by Oakhurst Blinds Limited, and the subject of the order made by You.  These terms are separate to our full Sales, Manufacture and Fit service.

You, Your and the customer means the person ordering Goods from Oakhurst Blinds.

Oakhurst Blinds or We or Us or Our means Oakhurst Blinds Limited (Company Number: 04663771) whose registered office is at Units 7 & 8 Mills Way Centre, Porton Road, Amesbury, Wilts, SP4 7AU.

Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when purchasing. This includes address and contact details. Oakhurst Blinds Limited cannot be held responsible for any incorrect details given.

Oakhurst Blinds Limited reserve the right to refuse access to the web site, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

Please note incoming and outgoing telephone calls may be recorded for training or monitoring purposes.

  1. OUR CONTRACT

When you place an order to purchase a product from Oakhurst Blinds Ltd , we will send you an E-mail confirming receipt of your order and containing the details of your order. On receipt of your confirmation please check all the details are correct as we cannot be held responsible for incorrect information given.

A legally binding contract with You will only arise once Oakhurst Blinds has received payment for the Goods in full from You. We shall notify You of acceptance of Your order by e-mail to the e-mail address given by You in the order form.

Payment can be made by VISA Debit, Mastercard, VISA Electron, VISA Credit or using PayPal. Payments made by Debit or Credit card are processed at point of order at which point your card will be debited for the full amount of the order.

Placing an order over the phone automatically means that you accept our terms and conditions.

 

  1. PRICING

All prices quoted include VAT at the current rate.  The ClearVue Self Fit/DIY Roof Lantern Blind has been developed by Oakhurst Blinds for the sale exclusively by Oakhurst Blind Limited.  The blind is not part of any other offers or promotional offers formed or compared to other companies selling pleated/honeycombe roof lantern blinds.

Please note that prices can change without prior notification in accordance with manufacturers updates.

All prices are inclusive of blind/frame/motors/remote control/packaging/delivery.

 

  1. STOCK SHORTAGES

If the Goods or the fabric You order are unavailable because of stock shortages or circumstances out of our control, we will notify immediately and give you a new projected delivery date.  An alternative fabric maybe offered (at our discretion) where fabric is discontinued or extended stock delivery times are specified by our suppliers.  Delivery dates specified is not the essence of the contract in circumstances out of our control.

 

  1. PRODUCT DESCRIPTIONS, SPECIFICATIONS AND MEASUREMENTS

4.1 The product information and photographs contained within Our web-site are provided for illustrative purposes only and We cannot warrant that they are accurate. If You are in any doubt as to the precise nature of the product or fabric You wish to order, You are advised to order a free sample of the product material.

4.2 If the Goods which You order are manufactured according to measurements and specification that You provide in Your order, it is very important that Your measurements are accurate and the product specification that you select is correct for your purpose. We cannot accept the return of the Goods by reason of the measurements or specification provided being incorrect. You are advised to read the How to Measure and Fit pages of Our web-site or contact us on blindsoffice@btconnect.com.   if You would like guidance on how to take the required measurements accurately.

4.3 Notwithstanding clause 4.2, all our products are made with a tolerance of +/-5mm and will not be considered faulty or misdescribed for the purposes of these terms and conditions if they fall within these parameters.

4.4 Whilst every attempt will be made by Oakhurst Blinds to ensure that the Goods sold and delivered match in every respect any sample or description shown or given or sent to You, any minor or immaterial variation or change in colour or pattern between the sample or description and the Goods delivered shall not entitle You to reject the Goods nor to claim any compensation for such variation or change

 

  1. EVENTS BEYOND OUR REASONABLE CONTROL

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. If we are unable to fulfil your order within 45 days we will give you the choice to either cancel your order or wait for us to fulfil your order.  All guarantees are exclusive and in lieu of all other obligations, liabilities or warranties. In no event shall Oakhurst Blinds Limited be liable or responsible for incidental or consequential damages or for any other direct or indirect damage, loss, cost of fitting, expense or fee.

The indicated delivery lead times are approximate only and there is no right to compensation if actual delivery takes longer.

Oakhurst Blinds ClearVue Self Fit/DIY Roof Lantern Blinds are designed to be self-fit and installation instructions, technical guidance and video assistance are always available, if you feel you need to employ an external fitting service, best practice is to have the products in hand prior to arranging any dates, as we cannot be held responsible for any fitting cost.

 

We would advise that This condition does not affect your statutory rights.

The images on our website are for illustrative purposes only. Products and fabric batch colours can differ or change slightly.

From time-to-time fabrics and products become discontinued and will be removed from our website at the earliest opportunity without prior notification.

We shall have no liability to You for any failure to deliver Goods You have ordered or for any delay in doing so or for any change of the specified delivery date or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond Our reasonable control including, without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

  1. WAIVER

If you breach our terms and conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

 

  1. GOVERNING LAW AND JURISDICTION

These conditions are governed by and construed in accordance with the laws of Scotland, England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English and Scottish courts.

13. RETURNS POLICY

All of our Blinds are made to measure, including ClearVue Self Fit/DIY Roof Lantern Blind, and are manufactured especially for you and to your specifications.  Therefore, you shall have no right to amend or cancel your order, return the goods or seek any refund of the price paid by you from us. This is because when we receive your order, the manufacturing process begins immediately, and the goods are manufactured to your exact specification.

Oakhurst Blinds offer a free sample service and we recommend customers use this before ordering to ensure the correct fabric/colour is chosen.

It is the customers/your responsibility to verify the details of the blind once you have ordered on receipt of order confirmation email, which will be sent to the email address provided by the customer at the point of order.  We strongly advise that you check all email addresses, including your spam/junk folder to ensure all communication is received by us.  Any alterations or changes must be communicated by us within 24 hours of order placed and paid for.

Made to measure products are custom made to your requirements/choice and under the distance selling regulations, we cannot accept any made to measure products back. Once made our products are suitable only to you and therefore cannot be cancelled or returned. Because of this, it is extremely important that you are sure about the product that you want and also the size you require. We strongly recommend that you double-check your order to ensure the products ordered and window codes/measurements are correct. This does not affect your statutory rights.

If you have received a faulty or damaged product, including but not limited to (incorrect sizing from your specification, fabric damage (not excluding flaws that are part of the fabric), mechanical performance on Somfy motors or parts, missing or lost parts, transit damage), please contact us within 24hrs of receipt.   Please include your order number and photographic evidence of the fault/damage, this will enable us to deal quickly and efficiently with the problem and to send out replacements parts.  We reserve the right to request that in such circumstances whereby Somfy products or blind are faulty, you return said products at your cost to Oakhurst Blinds for assessment and reporting whereby you will be offered upon assessment and reporting replacement parts and/or blind products and all costs for returns compensated.

If Oakhurst Blinds have made an error with your order, once evidence has been submitted, Oakhurst Blinds will bear all costs for collecting and supplying you with the correct products.

 

  1. REPRESENTATIONS

No statement, description, or recommendation contained in any catalogue, price list, advertisement, communication, the pages of this web-site or by any employee or agent of Oakhurst Blinds shall be interpreted so as to enlarge, vary or override in any way any of these terms and conditions.

 

  1. INVALIDITY

If any part of these terms and conditions is unenforceable (including any provision in which We exclude our liability to You) the enforceability of any other part of these conditions will not be affected.

 

  1. GUARANTEE

Guarantee is 1 Year from date of purchase.  Your ClearVue roof lantern blind is comprehensively quality checked and tested to guarantee free from faults and in working order prior to packaging and despatch.  Outside the 1 Year guarantee, Oakhurst Blinds Limited up to 3 years from date of purchase will repair or replace component parts as requested where You/The purchaser pay for replacement parts and cost of repair and labour.  The blind may have to be returned to the factory for repairs and the costs and responsibility of postage and packing the blind are to be borne by You/The purchaser.

 

Conditions Of Your Warranty

Your warranty also does not apply in relation to any defect(s) arising as a result of:

  • Instructions supplied by Oakhurst Blinds for fitting of blind and installation by yourself or representative.
  • Fair wear and tear affecting the products (e.g fabric fraying during use, or batteries running down). You are supplied with a solar panel and charger for re-charging batteries.
  • Wilful damage, misuse/abuse, abnormal storage or working conditions.
  • Your failure to operate or use the products in accordance with the installation.
  • Any alteration or repair by you or by a third party.
